What defines an OM-hearing?

An OM-hearing is a hearing at the district attorney’s office. At an OM-hearing the district attorney will handle the case. You still are a suspect. During the hearing your case will be discussed with the district attorney. In these cases it is common that the district attorney will offer a settlement. If you do not agree with the settlement offer you will need to go to court, where a judge will handle te case.

Do you need a lawyer in case of an OM-hearing?

You are not obliged to have a lawyer present at an OM-hearing. We do advise you to have a lawyer present at the hearing or to at least consult a lawyer before the hearing. The consequenses if you agree to the settlement offer could be immense, because you will have a criminal record.
